Tier II Reporting
The Emergency Planning and Community Right-to-Know Act (EPCRA) was established to help communities plan for potential chemical emergencies. By requiring industry to report on the use, storage, and release of hazardous substances, state governments and local communities can use this information to prepare for potential risks. Facilities containing chemicals at or above EPA thresholds must submit a chemical inventory (a Tier II report) to the state on an annual basis. This information must also be made available to the public.
In Oklahoma, the DEQ acts as the state’s central repository for Tier II information. Facilities electronically submit Tier II reports each year, and DEQ distributes them to Local Emergency Planning Committees (LEPCs) and fire departments statewide. Tier II reports are used by LEPCs to develop response plans for hazardous material spills or natural disasters. Fire departments use Tier II reports to pre-plan incident response; as well as prepare personnel for any chemicals or hazards that may be present when responding to emergencies.

- Facilities must provide an annual inventory report to the Oklahoma Department of Environmental Quality in the form of a Tier II Report due by March 1 of each year.

Facilities may log-in to the DEQ Online Filing System to download their Tier II Report from the previous reporting year. Usernames and passwords do not change from year-to-year.

Oklahoma Tier II Fees*
- Oil and Natural Gas Production Facilities: $12.00/ reported facility
- Agriculture Chemical Dealerships: $12.00/ reported facility
- Facilities under any other NAICS code:
- Hazardous Substance (as defined in 40 CFR Part 370): $15.00/ substance
- Extremely Hazardous Substance (as defined in 40 CFR Part 355): $30.00/ substance
*Maximum fee charged for a single reporting year is $1,000.00 per company. See OAC 252:20-1-7 for more information
Effective July 1, 2022, the Oklahoma Department of Environmental Quality will begin assessing customers a merchant fee in the amount of 2.25% of the amount due if paying via credit or debit card.
Additionally, a portal fee of $2.00 will be charged for each transaction paid by a credit or debit card.
